Purpose of the Low Income Study Committee is to determine whether Georgia’s low-income deviation (O.C.G.A. § 19-6-15(i)(2)(B) ) is adequately adjusting the presumptive amount of child support for low income non-custodial parents to ensure that the parent’s ability to pay the amount of child support.
The Committee was created in 2019, in part, by the recommendations in the 2018 Georgia Commission on Child Support Guidelines Final Report. The report noted that most states have a presumptive low-income adjustment based on the Federal Poverty Level for one person.
Georgia had a low-income deviation with self-support reserve formula from January 1, 2007 to August 31, 2009.
Currently, Georgia’s low income adjustment is a deviation with no stated amount. It can be requested by the non-custodial parent, custodial parent, court and the Division of Child Support Support Services.
Members were appointed by the Commission Chairperson.
